3. Description of Services

3.1 Overview of Services

NeuroCare Path operates a technology platform that facilitates connections between users and licensed healthcare providers (“Providers”) for the provision of telehealth services, with a focus on Attention-Deficit/Hyperactivity Disorder (“ADHD”) assessment, diagnosis, and treatment. The Services may include: (a) telehealth consultations via video, audio, or asynchronous messaging; (b) ADHD evaluations and assessments; (c) prescription management services; (d) care coordination; (e) access to educational resources; and (f) other healthcare-related services as may be offered from time to time.

3.2 NeuroCare Path's Role

NEUROCARE PATH DOES NOT PROVIDE MEDICAL SERVICES.

NeuroCare Path operates the technology platform through which you can connect with Providers. The Providers are independent healthcare professionals who use professional judgment in rendering telehealth services. NeuroCare Path provides administrative, payment, technological, and other supportive non-clinical services. The Providers, and not NeuroCare Path, are responsible for the quality and appropriateness of the care they render to you.

By using the Services, you may enter into a provider-patient relationship with one or more Providers, but you are not entering into a provider-patient relationship with NeuroCare Path.

3.3 Affiliated Medical Groups

The clinical services provided through the Platform are delivered by independent medical groups and their employed or contracted Providers (collectively, “Medical Groups”). NeuroCare Path has entered into agreements with Medical Groups to facilitate the delivery of telehealth services. Medical Groups are solely responsible for the healthcare services they provide and exercise independent medical judgment in diagnosing and treating patients.

4. Telehealth Services

4.1 Nature of Telehealth

Telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a healthcare provider and a patient who are not in the same physical location. Telehealth may be used for evaluation, diagnosis, treatment, follow-up care, and patient education.

4.2 Limitations of Telehealth

You understand and acknowledge that: (a) the Services are not a substitute for in-person medical care in all situations; (b) Providers cannot conduct physical examinations through telehealth; (c) the information you provide is essential to diagnosis and treatment; (d) there is no guarantee of diagnosis, treatment, or prescription; (e) technical failures may interrupt Services; and (f) Providers may determine that telehealth is not appropriate for your condition and may recommend in-person care.

4.3 Prescriptions and Controlled Substances

If a Provider determines that a prescription is appropriate, the prescription may be sent electronically to a pharmacy of your choice. You understand that: (a) there is no guarantee that a prescription will be written; (b) prescriptions are subject to Provider discretion and applicable law; (c) ADHD medications may include controlled substances that are subject to additional federal and state regulations; (d) controlled substance prescriptions require compliance with additional protocols, including periodic check-ins and potential drug screening; and (e) NeuroCare Path does not guarantee the availability of any medication at pharmacies.

5. User Responsibilities

You agree to: (a) provide accurate, complete, and current medical history and health information; (b) inform Providers of all medications, supplements, and substances you are taking; (c) follow Provider recommendations and treatment plans; (d) notify your primary care physician of any treatment received through the Services; (e) comply with all applicable laws and regulations; (f) use the Services only for lawful purposes; (g) maintain the confidentiality of your Account credentials; and (h) ensure you are in a private, secure location during telehealth visits.

You agree NOT to: (a) provide false or misleading information; (b) use the Services for emergency medical situations; (c) attempt to obtain controlled substances for non-medical purposes; (d) share medications prescribed through the Services with others; (e) interfere with the proper functioning of the Platform; (f) violate any applicable laws or regulations; or (g) engage in any conduct that could harm other users or Providers.
